The Federal High Court in Lagos has set aside the ex parte order previously granted to FBN Quest Merchant Bank and First Trustees Limited against Nestoil Limited and Neconde Energy Limited.

City Echo NG reports that the ruling, delivered today, 20 November 2025, reaffirmed that ex parte orders are meant to preserve the subject matter of a dispute temporarily and cannot be allowed to subsist indefinitely.

The Court held that the request by the FBN entities to halt further proceedings while leaving the ex parte order in place was contrary to this established legal principle. It was also noted that the original order had been obtained without the participation or knowledge of Nestoil and Neconde, and through the suppression of material facts.

With the order now vacated, Nestoil and Neconde have regained full control of their operations.

Both companies restated their commitment to transparency, lawful business conduct and strong corporate governance, adding that they remain focused on delivering value to stakeholders and supporting the growth of Nigeria’s energy sector.
